Before purchasing a property, make sure you have a licensed land surveyor review the title for possible easements. 

We have unfortunately seen many client’s face issues after purchasing a property because they didn’t know the importance of checking a title or surveying the property’s boundaries at the time of purchasing.

The Case of the Easement

A young couple purchased a small 1970s home on a larger piece of land. Their goal was to eventually renovate and extend on the established home as their family grew.

After 8 years living in their property, the growing family had an architect draw up some plans for a 3 bedroom, living room and kitchen renovation and extension.

During the design process, they engaged the Linear team to complete a Title Re-establishment (Boundary) Survey and a Feature & Level Survey. These surveys are crucial to the design team and ensure the plans fit within the property’s boundaries.

We unfortunately had to inform the family that their title included an easement for drainage, which they were not permitted to build across. This drainage easement caused significant issues to their renovation and extension dreams. The couple recognised that they would not have purchased the property had they known their development goals were going to be hindered this significantly.

Unfortunately, this young family were not able to build the extension they originally had hoped for and were forced to spend more money to work with their architect on alternative designs.
