Do I need a Planning Permit or a Building Permit?

If you are about to begin a development project on your land, a key first step is to find out whether you require a planning or building permit.

It is likely that you will require both permits. Planning and building permits are required by law unless your development is exempt under existing regulations.

Therefore, developing a solid understanding these two permits is essential to your development’s success.

Planning Permits

Planning Permits must be issued by your local council.

Essentially, a Planning Permit is a legal document that authorises the development or use of your land for a specific purpose.

For example, you may be altering the use of your land through the process of subdivision. You may be constructing a new dwelling on the land or altering the existing dwelling by renovation or extension. The above land uses would require a planning permit.

It is important to note that acquiring a Planning Permit does not remove the need to obtain a building permit, if one is required for your development.

If your development project requires both a Planning and Building Permit, your Planning Permit must be obtained before your Building Permit can be issued.

Building Permits

Building Permits are generally issued by a private or municipal Building Surveyor.

A Building Permit certifies that the proposed building plans and construction complies with all relevant building regulations.

A Building Permit will require an Occupancy Permit or Certificate of Final Inspection to be obtained upon completion of the build.
